Disparti Law Group has filed a lawsuit on behalf of the family of a union ironworker who was fatally injured while working at a construction site in Joliet, Illinois, alleging that preventable safety failures led to the worker’s death.

The fatal incident occurred on December 15, 2025, at the future site of Boulevard Place, a Costco-anchored retail development located near the Interstate 55 and U.S. Route 30 interchange. According to the complaint, Thomas “Tom” Kircher, a member of Ironworkers Local 444, was performing job-related duties when the incident occurred. Emergency responders were called to the scene, but Kircher later died from his injuries.

The lawsuit seeks accountability for what the family claims were lapses in safety oversight, training and worksite protections. Construction work remains one of the most hazardous industries in the country, and worker advocates stress that employers and project stakeholders have a responsibility to enforce rigorous safety standards.

Kircher is survived by his two sons, Alexander and Joseph Kircher. Beyond the emotional toll of losing a parent, families affected by workplace fatalities often face immediate financial uncertainty related to lost income, benefits and long-term security.

Illinois law allows surviving family members to pursue legal claims beyond workers’ compensation when third-party negligence may have contributed to a workplace death. The lawsuit was filed in Will County Circuit Court as investigators continue to examine the circumstances surrounding the incident.
